The following Terms and Conditions apply to purchases made from the One Denim website, www.onedenim.com.
Your acceptance of the Terms and Conditions is given when you make a purchase from One Denim, so please read through all our conditions including our Privacy Policy and any other information contained on other pages or websites referred to in this notice.
One Denim reserves the right to change these Terms and Conditions at any time, and any such change will be effective to all new orders once included in the text of these Terms and Conditions and published on the website.

New Customer

You may browse our website without registering but you will need to create an online account to purchase from us.
When you become an online customer, you are responsible for all actions taken under that username, whether by you or by any other person, and therefore it is your responsibility to keep your username and password safe at all times. If you become aware of any unauthorized use of your credentials, you must notify our Customer Service immediately.

Please also ensure that the information you provide is true and accurate in all respects and that you update your information immediately for any changes. You can update your details at any time by logging in to your One Denim account.

Product Information

Whilst every effort has been made to reflect the true colours accurately, we cannot guarantee that the colour you will see on your monitor will reflect the true colour of the product.

Purchasing Products

All prices displayed on our website are quoted in GB Pound Sterling.
If the card you are using is denominated in any other currency, the final price will be calculated by your card issuer. You should seek confirmation from your card issuer as to the exchange rate and applicable charges they may apply on your account. The final price is calculated and charged by your card issuer or bank or payment method provider, therefore One Denim is not responsible for any additional fees, charges or other liabilities incurred or suffered by you.

All prices are quoted inclusive of packaging but exclusive of postage (except where specified), which will be charged at the rates specified during the checkout process.

Prices of products bought within the United Kingdom and European Union are inclusive of the current rate of VAT at 20% (UK Tax).
Goods purchased from outside of the United Kingdom and European Union will be sent DDU (Delivery Duty Unpaid). Import duty and/or tax costs (if applicable) will be invoiced directly to you from our dedicated courier or an import broker. In order to avoid unexpected charges, we recommend all our customers to contact local customs authority to determine import duties and taxes prior to completing the order.

Orders, Pre-Orders and Advanced Payment

Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order.
Unless you cancel your order, acceptance of your order and completion of the contract between you and One Denim will be completed when we email you your order confirmation. The sale contract is therefore concluded in England and the language of the contract is English. Neither our third party payment processor nor our nominated courier has the authority to accept an order on behalf of One Denim.

We may refuse to process and therefore accept a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any merchandise from One Denim website whether or not that merchandise has been sold, removing, screening or editing any materials or content on One Denim website, refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

If an item you wish to purchase is out of stock you may pre-order it, where applicable. Where goods are offered on a pre-order basis, at the checkout stage of your order, you will be given the opportunity to make Advanced Payment for your purchase, which will ensure your order takes priority when the goods become available.

We aim to deliver pre-ordered products on the official launch date advised to you on our website, provided that we have received and processed your payment. One Denim will endeavour to deliver on the due date or before, however, should there be any unforeseen circumstances, we will deliver to customers in strict chronological order, which may be after the launch date. If you are not satisfied with the delays, you may cancel your order at anytime by contacting our customer service team.

Please note that pre-ordered goods can be paid for by credit/debit cards only. Due to policy regulations they cannot be paid using your PayPal account.

Delivery Delays

If there is a delay or likelihood of delay in the delivery of products, One Denim Customer Service will advise you accordingly. If you are an international customer and the product you ordered cannot be delivered within 10 days of your order, you may either request cancellation of your order or agree a new delivery time with Customer Service. If you are a UK customer and the goods are not delivered to you within 7 working days of your order, you may also request a cancellation (providing that our courier did not attempt delivery of the parcel to you) or agree a new delivery with our Customer Service.

Orders you place with us will not be accepted until you receive an automatically generated email confirming that the product you ordered is available and your payment has been received in full. Payment shall not be deemed complete until we receive cleared funds. Prior to dispatch of your order you will receive shipping confirmation.

One Denim reserves the right at all times and at its sole discretion to accept or cancel any orders.

If you exercise a right to cancel your order but the goods have already been dispatched, please follow the Returns Procedure (see Returns and Exchange), which also governs refunds.

Gift Cards

The One Denim gift cards can be redeemed in its face currency, GBP Pounds. One Denim gift cards can be purchased in amounts as shown on our website. Please note that gift cards are not eligible for cash refunds.

The gift card is sent via email and contains a gift card code and expiry date. Gift cards are valid for 12 months and must be used by the date shown on the gift card. At the end of this period any unused balance will be forfeited.

When payment has cleared the gift card will be sent to the recipient via email. Once the gift card has been delivered to the recipient, One Denim will accept it in exchange for goods by any person who presents it for purchase and, therefore, it is the purchaser’s responsibility for safekeeping and use. Moreover One Denim cannot be held responsible for any incorrect or non-existent email address supplied by a purchaser, or a gift card that is lost or stolen.

We kindly advise our customer to check spam filters as from time to time gift cards can get caught up as spam. One Denim is not liable for gift cards that cannot be delivered to the recipient’s email address because of spam filters, firewalls or other security measures operating on the recipient’s system, capacity of the recipient’s mailbox and/or any other factors outside our control. Please add onedenim.com to your contact list to help avoid this issue.

In order to redeem the gift card its recipient will require to register an account at www.onedenim.com.

If the recipient’s order value exceeds the store credit value the recipient must pay the difference by debit/credit card or PayPal.
If the recipient’s order value is less than the store credit the remaining balance after purchase will stay on his/her One Denim website account for future use. In this case the recipient will receive the remaining balance in form of a store credit an email with another gift card for ‘change’ which will be used against future purchases.

Please kindly be advised all orders paid for with gift cards that are returned or cancelled will be refunded in a form of a store credit for future use.

One Denim reserves the right to refuse to accept gift card in payment or in part payment for any item where it reasonably suspects that the original gift card or any amount on it may have been stolen.
Please note gift cards cannot be used to buy further gift cards.

Delivery

One Denim is proud to offer free express shipping in the UK, as well as other selected European and international destinations. Shipping to other territories have been subsidised by One Denim to keep shipping costs as low as possible. At check out you will be able to check the delivery costs to your destination (if applicable). Please note that delivery times are subject to possible delays due to credit card authorisation, customs and compliances and other factors outside the control of One Denim. One Denim ensures product will be delivered to the countries featured in our shipping list. We are constantly expanding our shipping list, however if you cannot find your destination country please contact us on +44 (0) 2037 447 111 (between 09.00 and 18.00 GMT Monday – Friday except public holidays in England) or via email to support@onedenim.com.

For our customers’ convenience there is an option of tracking the status of the order available when logging in to “My Account” on One Denim website. Moreover, each customer will be notified when the goods have been dispatched and will be provided with the tracking number and courier details (for more details please check our Shipping FAQs).

On our checkout page, if a customer selects the destination country that is not included in our shipping list or the delivery address the customer entered does not correspond to the destination country, the order will not be processed. Please contact One Denim Customer Service for further inquiries.

We aim to deliver your purchase to any country in our shipping list. Please note the estimated delivery dates will be available on the checkout page where you can select the delivery service that suits you.

If nobody is in to receive the parcel, you can contact the courier to schedule a new delivery time. You may add any special delivery instructions during the ordering process. Please note it is our customer’s responsibility to provide complete and correct delivery address. One Denim is not responsible for any deliveries attempted to the incomplete or incorrect addresses. If you have provided us with incomplete or incorrect address, please contact One Denim Customer Service immediately.

Please note One Denim will deduct any return postage fees or dedicated courier fees (if charged) from the amount to be refunded to you when the parcel is returned to us, if you for any reason prevent delivery of the goods by either failing to supply the courier, your local customs, tax office with necessary documentation, or failing to pay local customs, taxes or courier’s administration fees.

Returns and Exchanges

All our customers are eligible for a refund or exchange (if stock is available) on any unworn/unused/unwashed goods (faulty or otherwise) with the all tags intact, within 14 days of receipt of the goods including all original packaging. Goods returned without all tags intact and original packaging may be refused. Our branded boxes and bags are considered to be a part of the product and must be returned with item(s). Please see our returns/exchanges section on our site for more information.

Customer Rights

All our customers based in the EU may exercise the right to cancel their orders with us provided they have given us written notice under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2014 (ICACRs).

The cancellation period will expire 14 days from the day after the day on which you acquire (or a third party other than a carrier and indicated by you acquires) physical possession of the last of the goods.

All items must be returned unused/unworn/unwashed, in their original condition and packaging with all their labels intact and from the country that the order was delivered to. Our branded boxes and bags are considered to be a part of product and must be returned with the item(s). One Denim will refund the full value of your order, excluding shipping costs, within 14 days of receiving your notice of contract cancellation. We may arrange collection from you at your cost.

Acceptable Use

All One Denim customers must agree that they will be personally responsible not only for the use of One Denim website but also for all their communications and activities in accordance with One Denim Terms and Conditions. One Denim has a right to deny you access to the website on a temporary or permanent basis if we determine that you have breached the acceptable use of the website or any other One Denim Terms and Conditions by:

• Damaging or interrupting the use of One Denim website and/or its software;
• Placing illegal, abusive, chauvinistic materials, provoking violence towards people’s privacy, religion and committing any other act which may cause harm;
• Creating disruptions to One Denim company, its employees, suppliers and other third parties.
One Denim may also use its discretion in removing or not publishing any material or comment made by our customers that in our opinion does not meet the content standards.

Indemnity

You hereby agree to be responsible to One Denim for and keep One Denim indemnified against all costs, damages, legal fees, expenses, losses and liabilities incurred and/or suffered by One Denim as a result of any claim made in respect of your use of One Denim website.

Trade Marks and Copyright

The One Denim trade mark as well as other marks and logos, trade names, business names whether registered or not are and remain the exclusive property of One Denim.

One Denim trademarks are the intellectual property of One Denim and any unauthorised use or copy of our marks is an infringement, which will give rise to litigation. Your access of the One Denim website and your use of it does not give you any rights to use our trademarks.

All content including but not limited to logos, photographs, graphics, and texts on this website are the property of One Denim, and is protected by applicable copyright and other intellectual property laws.

Subject to the terms and conditions contained herein, we grant you revocable and non-exclusive licence to access and make personal use of the website.

Termination and Suspension

One Denim is eligible to immediately terminate your limited licence, cancel your website registration and/or deny your access to all or part of the website without notice if:

• You used the website in a way that may damage the reputation of One Denim;
• You used the website for commercial or business purpose;
• You breached any part of our agreement;
• You used data gathering tools that entailed unreasonable risks to our infrastructure and security of any other website user;
• Your actions may cause legal liability for us, you or any other third party.

We value our customers’ feedback, therefore if for any reason you are not 100% satisfied with the level of service or quality of product, please email us on support@onedenim.com.

General

These Terms and other documents referred to in them constitute the whole agreement between us.
One Denim reserves the right to make any amendments to this agreement at any time by posting an amended agreement on our website. The amended agreement will be immediately posted on One Denim website for our customers’ reference and will govern new Terms and Conditions from the date it was posted.

Nothing in this agreement shall be understood to establish any agency, partnership, joint venture, employee-employer, partnership, or any other relationship between you and us unless otherwise strictly stated.

If any provision of this agreement is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall remain in full force and effect.

You cannot assign this agreement without express authority.
No person who is not a party to this agreement has any right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement. This does not affect any right or remedy generally available to such a third party in law or otherwise.

Governing Law

These terms of use, contracts for the purchase of products made via One Denim website are governed by English law and, moreover, the English courts will have exclusive jurisdiction for any dispute under this agreement.

We advise all our customers to ensure that their use of One Denim website and service is legal, as there may be additional legal requirements for our customers to use One Denim website or services due to differences raised between English law and our customers’ country law.
